Terms of Service

1. Acceptance of these Terms

By creating an account, joining the waitlist, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Platform. If you use the Platform on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms.

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Platform. You are responsible for the accuracy of your account information and for all activity under your account, you must keep your credentials confidential, and you may not share an account or let anyone else use it. You may use the Platform only where doing so is lawful in your location. We may refuse, suspend, or close an account that breaches these Terms or that we reasonably believe poses a risk to others or to our systems.

3. Waitlist and pre-launch status

The Platform is currently in pre-launch. Joining the waitlist registers your interest; it does not create an account, guarantee access, or form a paid contract. During pre-launch, features, scenarios, availability, and pricing are not final and may change or be withdrawn. Any paid plans, and the billing terms in Section 9, apply only once paid access is made available to you.

4. Acceptable use and rules of engagement

The Platform is an educational training environment that simulates offensive and defensive cybersecurity scenarios. To keep it safe and lawful for everyone, you agree to the following.

Sandbox isolation

All simulations run inside isolated, single-use environments. You must not attempt to escape a simulation container, compromise the underlying infrastructure or hypervisor, access other users' sessions or data, or launch denial-of-service or other attacks against our systems. Any such attempt may lead to immediate suspension or termination and, where warranted, referral to the relevant authorities.

No off-platform misuse

You must not use any tools, techniques, scripts, or knowledge gained on the Platform to conduct unauthorised, malicious, or illegal activity against any network, system, or person outside the Platform. The Platform is for authorised training only.

Other prohibited conduct

You also agree not to: reverse engineer, decompile, scrape, or copy the Platform except as the law expressly allows; resell, sublicense, or commercially exploit the Platform without our written permission; access the Platform by automated means or circumvent any security, rate limit, or access control; impersonate any person or misrepresent your affiliation; upload malware intended to harm the Platform or other users; infringe the intellectual property or privacy rights of others; or use the Platform in violation of any applicable law, including the export-control and sanctions laws that may apply to security tools.

5. User content and conduct

You may be able to submit content such as a display name, messages, write-ups, or feedback (“User Content”). You retain ownership of your User Content and are solely responsible for it. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, and use User Content to operate, secure, and improve the Platform. You must not post content that is unlawful, infringing, deceptive, or harmful. We may review, moderate, or remove User Content and may suspend accounts in line with our moderation practices, but we are not obliged to monitor it.

6. The AI Coach

The AI Coach provides automated guidance for training purposes only. Its output may be incomplete or inaccurate and is not professional, legal, or security advice. You must use your own judgement and must not rely on the AI Coach for decisions affecting real-world systems. You are responsible for how you apply anything learned on the Platform.

7. Intellectual property

The Platform, including its software, content, scenarios, and branding, is owned by EEVSEC or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended training purpose. If you send us suggestions or feedback, you grant us the right to use them without restriction or any obligation to you.

8. Third-party services and links

The Platform relies on third-party providers (for example, hosting and content delivery, email and waitlist services, form delivery, web fonts, and, where enabled, analytics) and may contain links to third-party sites. We are not responsible for third-party services or sites, and your use of them is governed by their own terms and privacy policies.

9. Subscriptions, billing, and changes

We do not currently take payments (see Section 3). When paid plans are available, they are billed in advance on a recurring basis until cancelled. You can cancel at any time from your account settings; cancellation stops future renewals and your access continues until the end of the current billing period. Refunds are governed by our Refund & Cancellation Policy.

We may modify, suspend, or improve features of the Platform at any time. We will not apply material changes to fees, usage limits, or your core rights without giving you reasonable advance notice (at least 15 days where practicable) by email or in-product notice, so you can cancel before the change takes effect if you do not agree.

10. Privacy and your data

Our Privacy Policy explains what personal data we collect and how we use, share, and protect it, and it forms part of these Terms. The Platform stores a small number of first-party cookies and local-storage values: an essential cookie that records your cookie choice and a theme preference, and, only with your consent, analytics (a first-party visit cookie and, where enabled, Google Analytics) to understand how the site is used. You can accept, decline, or withdraw consent at any time through the cookie notice. By using the Platform you acknowledge the Privacy Policy and the processing of your data as described there.

11. Disclaimers

The Platform is provided on an “as is” and “as available” basis for training purposes only. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted or error-free, or that skills practised on the Platform will prevent any real-world incident.

12. Limitation of liability

To the fullest extent permitted by law, EEVSEC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any security breach, network compromise, data loss, or downtime in any real-world system, including systems configured using strategies practised on the Platform. Our total liability for any claim relating to the Platform is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or, where no payment was made, a nominal sum. Nothing in these Terms limits any liability that cannot be limited under applicable law, including your mandatory consumer rights.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless EEVSEC and its officers and staff from any claim, loss, or expense (including reasonable legal fees) arising from your misuse of the Platform, your breach of these Terms, your User Content, or your use of skills or tools from the Platform against systems you are not authorised to test.

14. Termination

You may stop using the Platform and close your account at any time. We may suspend or terminate your access if you breach these Terms or use the Platform in a way that risks harm to others or to our systems. Provisions that by their nature should survive termination, such as intellectual property, disclaimers, limitation of liability, and indemnification, will continue to apply.

15. Governing law and dispute resolution

These Terms are governed by the laws of India, and the courts of Ahmedabad, Gujarat, India have jurisdiction over any dispute, without prejudice to the mandatory consumer-protection rights you may have in your country of residence. Before starting formal proceedings, please contact us so we can try to resolve the matter informally. If any provision of these Terms is held unenforceable, the remaining provisions stay in effect.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here with a new effective date and, for material changes, provide additional notice as described in Section 9.

17. General

These Terms, together with the Privacy Policy and the Refund Policy, are the entire agreement between you and us about the Platform. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. We are not liable for delays or failures caused by events beyond our reasonable control. Notices to you may be given by email or in-product notice; notices to us should be sent to the contact details below. Section headings are for convenience only.
